The United States Citizenship and Immigration Services (USCIS) has published a final rule on January 30, 2024, adjusting various immigration and naturalization benefit request fees for the first time since 2016. The rule is set to take effect on April 1, 2024.
USCIS, which is primarily fee-funded, aims to recover its operating costs more fully and facilitate the timely processing of new applications through this fee adjustment. Approximately 96% of USCIS funding comes from filing fees, with only about 4% from congressional appropriations.
Key Highlights of the Final Rule:
Effective Date: April 1, 2024
Grace Period: From April 1, 2024, through June 3, 2024, USCIS will accept prior editions of most forms, provided they are filed with the correct fee.
New Forms: USCIS introduces new editions of certain forms, including Form I-129, Form I-129 CW, Form I-140, Form I-600A, and Form I-600. A preview of each new form edition is available for review before the April 1, 2024, effective date.
Fee Changes: The final rule limits newly established fees for individual filers to no more than a 26% increase in the Consumer Price Index since 2016. Fee increases are kept low for naturalization and adoption applications and petitions.
Online Filing Discount: A $50 discount is offered for online filing of forms where USCIS provides an online filing option.
Differences from the Proposed Rule:
In response to over 5,400 public comments received during the notice of proposed rulemaking in January 2023, the final rule includes several important changes:
- Every fee is the same or lower compared to the proposed rule.
- The agency’s required annual cost recovery is lowered by $727 million.
- Fee exemptions are expanded for various groups, including Special Immigrant Juveniles, victims of human trafficking, crime, and domestic violence, U.S. military servicemembers, Afghan allies, and families pursuing international adoption.
- Special fee discounts are introduced for nonprofits and small employers.
- Eligibility for reduced-fee naturalization applications is expanded for individuals with household income between 150% and 400% of the Federal Poverty Guidelines.
Additional Changes in the Final Rule:
- Biometric services costs are incorporated into the main benefit fee, eliminating the separate biometric services fee in most cases.
- The $30 returned check fee is eliminated.
- Separate filing fees are required for Form I-485, Form I-131, and Form I-765, whether filed together or separately.
- Separate fees are established for Form I-129, Petition for a Nonimmigrant Worker, by nonimmigrant classification.
- Premium processing timeframe interpretation is revised from calendar days to business days.
- Various changes are made to USCIS processes for adoptions, including fee exemptions for certain adoptees.
The USCIS encourages filers to review the new fee schedule and form editions before the rule’s effective date. The adjustments aim to strike a balance between recovering operating costs and ensuring accessibility for various immigrant and nonimmigrant categories.
