The U.S. Citizenship and Immigration Services (USCIS) has introduced a new edition of Form I-485, Application to Register Permanent Residence or Adjust Status, featuring significant updates to questions and instructions. The revised form, dated 10/24/24, was officially published on December 10, 2024. Starting February 10, 2025, USCIS will only accept this updated version, rejecting any older editions submitted after this date.
One major update requires applicants who need to include Form I-693, Report of Immigration Medical Examination and Vaccination Record, or a partial Form I-693 (such as a vaccination record), to submit it along with their Form I-485. Failure to include the required Form I-693 may result in the application being rejected. This change emphasizes the importance of submitting all necessary documentation at the time of application.
Another significant change involves the discontinuation of Form I-864W, Request for Exemption for Intending Immigrant’s Affidavit of Support. Applicants who are exempt from submitting Form I-864, Affidavit of Support, can now request the exemption directly on the updated Form I-485. By incorporating Form I-864W into Form I-485, USCIS aims to simplify the process and reduce the number of forms applicants need to complete.
Additionally, the updated form provides clearer questions regarding the public charge ground of inadmissibility. Applicants will now be required to specify their immigrant category, allowing USCIS to more easily determine exemptions from this ground of inadmissibility. This clarification is expected to minimize confusion for applicants and streamline the adjudication process.
USCIS has also revised and consolidated the form’s instructions to improve user experience and reduce administrative burdens. These changes align with the agency’s broader initiative to make immigration benefits and services more accessible and efficient for applicants.
Applicants are advised to carefully review the updated Form I-485 and its instructions to ensure they are using the correct version. Submitting the wrong version after February 10, 2025, could result in delays or rejection of the application. These updates aim to provide greater clarity and efficiency for applicants navigating the adjustment of status process.
