USCIS Urges Applicants to Submit Correct Fees for Work Permits Following an Increase in Errors

The United States Citizenship and Immigration Services (USCIS) is urging applicants to double-check fee amounts when submitting work permit applications. In response to an increase in work permit applications submitted with incorrect fees, USCIS is advising applicants to ensure they are submitting the correct amounts. The agency has reported a noticeable rise in errors since fee adjustments were implemented on April 1.

“On January 31, 2024, USCIS published a final rule that adjusts certain immigration and naturalization benefit request fees. This final rule went into effect on April 1, 2024. Since then, USCIS has seen a significant increase in Forms I-765, Application for Employment Authorization, being filed without the correct fee,” said USCIS in a notice.

For work permit applications (Form I-765), the fee for online submissions is $470, while paper submissions require a fee of $520. Applicants filing for a work permit in conjunction with a green card application (Form I-485) that has already had its fees paid must submit $260.

Additionally, for adjustment of status applicants (category (c)(9)), a fee of $260 applies if Form I-485, Application to Register Permanent Residence or Adjust Status, was filed with a fee on or after April 1, 2024, and is still pending.

Furthermore, if you are a (c)(9) or (c)(16) Current Adjustment of Status or Registry applicant and filed Form I-485 on or after July 30, 2007, and before April 1, 2024, and paid the I-485 fee, there is no fee to file Form I-765 while your Form I-485 remains pending, according to USCIS.

USCIS emphasized that any forms postmarked on or after April 1, 2024, that are filed with incorrect fees will be rejected.  For detailed information on the updated fees, click here.
